TERMS & CONDITIONS

1. AGREEMENT TO THESE TERMS
These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“Customer”, “User”, “you”, or “your”) and Cloudme Digital Co. W.L.L., trading as GoDomains (“GoDomains”, “we”, “us”, or “our”), a company incorporated in the Kingdom of Bahrain with its registered office at Office 24, Building 624, Road 2808, Block 428, Seef, Kingdom of Bahrain (VAT Registration Number: 220002875100002).
These Terms govern your access to and use of:
together with any related websites, customer portals, applications, APIs, products, and services offered by GoDomains (collectively, the “Services”).
By accessing, browsing, purchasing, registering for, or otherwise using any of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and any policies incorporated by reference.
If you do not agree to these Terms, you must immediately discontinue use of the Services.

Where a service-specific agreement conflicts with these Terms, the service-specific agreement shall prevail with respect to that Service.
3. ELIGIBILITY
You represent and warrant that:

You are at least 18 years of age;

You have the legal capacity to enter into binding agreements;

All information provided to GoDomains is accurate and complete;
-
You will maintain accurate and up-to-date account information.
If you are acting on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
4. CUSTOMER ACCOUNTS
Certain Services require the creation of an account.
You are responsible for:

Maintaining the confidentiality of your credentials;
-
Restricting unauthorized access to your account;
-
All activities occurring under your account.
You must promptly notify GoDomains of any unauthorized access or security incident affecting your account.
5. SERVICES
GoDomains provides digital infrastructure and technology services, including but not limited to:

Domain name registration, renewal, transfer, and management services;
-
DNS and domain-related services;
-
Shared hosting services;
-
Cloud hosting and virtual private server services;
-
Business email and productivity services;
-
SSL certificates and security services; and
-
Other related products and services offered from time to time.
The availability of Services may vary by product, jurisdiction, technical requirements, or regulatory restrictions.
6. THIRD-PARTY PROVIDERS
Certain Services may be delivered through third-party registry operators, registrars, cloud providers, software vendors, infrastructure providers, payment processors, and technology partners.
Additional terms, policies, and requirements imposed by such third parties may apply.
GoDomains remains your contractual service provider unless expressly stated otherwise.
7. ORDERS AND ACCEPTANCE
Submission of an order does not guarantee acceptance.
GoDomains reserves the right to:

Reject orders;

Request additional verification;
-
Suspend provisioning;
-
Refuse Services where fraud, abuse, legal restrictions, technical limitations, or security concerns are identified.
A contract is formed only when GoDomains accepts and processes your order.
8. PRODUCTS, ORDERS & PAYMENTS
You agree to provide accurate, complete, and current billing information.
Unless otherwise stated, all prices are displayed in Bahraini Dinars (BHD).
GoDomains may accept payment through various methods including credit cards, debit cards, bank transfers, payment gateways, and other methods made available from time to time.
Prices, fees, taxes, and charges may be modified at any time without affecting previously accepted orders.
Refunds, cancellations, and chargebacks are governed by the Refund & Chargeback Policy.
9. RENEWALS
Certain Services renew automatically unless cancelled before the applicable renewal date.
You are solely responsible for:

Monitoring renewal dates;
-
Maintaining valid payment methods;
-
Ensuring sufficient funds are available.
Failure to renew may result in suspension, expiration, deletion, loss of service, or loss of associated data.
GoDomains shall not be liable for losses arising from failure to renew.
10. CUSTOMER RESPONSIBILITIES
You are responsible for:

Maintaining accurate account information;
-
Ensuring the legality of your activities;
-
Securing your own systems, passwords, and data;
-
Complying with all applicable laws and regulations;
-
Maintaining backups where appropriate.
You remain responsible for all content, activities, and actions conducted through your account and Services.
11. REGULATED ACTIVITIES
Unless expressly agreed in writing, the Services are not designed, certified, or represented as compliant with any specific healthcare, financial, governmental, defense, or other industry-specific regulatory framework.
You are solely responsible for determining whether the Services are suitable for your intended use and regulatory obligations.
12. PROHIBITED ACTIVITIES
You may not use the Services in any manner that:

Violates applicable law;
-
Infringes intellectual property or other rights;
-
Facilitates fraud, phishing, identity theft, or deceptive practices;
-
Distributes malware, ransomware, viruses, or harmful code;
-
Interferes with systems, networks, accounts, or Services;
-
Sends spam or abusive communications;
-
Attempts unauthorized access to systems or data;
-
Circumvents security controls or restrictions;
-
Harms the security, integrity, stability, or reputation of GoDomains, its customers, partners, or infrastructure providers.
Additional restrictions are contained within the Acceptable Use Policy.
13. DOMAIN NAME SERVICES
Registration of a domain name does not create or confer trademark rights, intellectual property rights, ownership rights beyond the applicable registration period, or any guarantee of continued registration.
Domain registrations remain subject to the policies, procedures, and requirements of the applicable registry operator, registrar, dispute resolution provider, and regulatory authority.
GoDomains does not guarantee the availability of any domain name until registration has been successfully completed.
14. SUSPENSION
GoDomains may suspend, restrict, lock, disable, or otherwise limit access to Services where reasonably necessary to:

Protect infrastructure or customers;
-
Investigate abuse or fraud;
-
Enforce these Terms;
-
Comply with legal or regulatory obligations;
-
Respond to requests from registries, authorities, or courts;
-
Prevent harm to third parties.
Suspension may occur without prior notice where immediate action is required.
15. TERMINATION
GoDomains may terminate Services where:
-
Fees remain unpaid;
-
Fraud is suspected;
-
Abuse is detected;
-
Verification requirements are not met;
-
Continued provision would violate applicable law or policy.
Termination does not relieve you of outstanding payment obligations.
16. INTELLECTUAL PROPERTY
All trademarks, logos, software, content, designs, text, graphics, and materials provided through the Services remain the property of GoDomains or their respective owners.
Nothing in these Terms transfers ownership of any intellectual property rights.
17. CUSTOMER CONTENT
You retain ownership of content you submit, upload, host, transmit, or otherwise make available through the Services.
You grant GoDomains a limited right to process, store, transmit, and otherwise use such content solely as necessary to provide the Services.
You are solely responsible for your content and its legality.
18. DATA PROTECTION
Collection, use, storage, and disclosure of personal information is governed by the Privacy Policy.
You acknowledge that certain information may be disclosed where required by law, court order, regulatory authority, registry policy, dispute resolution process, or legitimate security requirements.
19. ELECTRONIC COMMUNICATIONS
You consent to receive communications electronically, including notices, invoices, account updates, security notifications, legal notices, and service-related communications.
Electronic communications satisfy any legal requirement that such communications be in writing.
20. DISCLAIMERS
The Services are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, GoDomains disclaims all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted availability, or error-free operation.
21. LIMITATION OF LIABILITY
To the fullest extent permitted by law, GoDomains shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, business opportunities, goodwill, data, or business interruption.
GoDomains’ total aggregate liability arising from any claim shall not exceed the amount paid by you for the affected Service during the twelve (12) months immediately preceding the event giving rise to the claim.
22. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless GoDomains, Cloudme Digital Co. W.L.L., their affiliates, officers, directors, employees, contractors, and representatives from any claims, losses, liabilities, damages, costs, or expenses arising from:

Your use of the Services;
-
Violation of these Terms;
-
Violation of applicable law;
-
Infringement of third-party rights.
23. FORCE MAJEURE
GoDomains shall not be liable for any delay, interruption, degradation, suspension, failure, or inability to perform obligations resulting from events beyond its reasonable control, including natural disasters, war, armed conflict, terrorism, civil unrest, government actions, sanctions, labor disputes, cyberattacks, power outages, telecommunications failures, internet disruptions, failures of registries, cloud providers, infrastructure providers, software vendors, payment processors, or other third-party services.
GoDomains shall not be obligated to provide refunds, credits, or compensation arising from Force Majeure events.
24. CHANGES TO SERVICES
GoDomains may modify, suspend, replace, or discontinue any Service where reasonably necessary for operational, technical, regulatory, security, or business reasons.
25. CHANGES TO THESE TERMS
GoDomains may update these Terms from time to time.
Updated Terms become effective upon publication unless otherwise stated.
Continued use of the Services constitutes acceptance of the revised Terms.
26. ASSIGNMENT
GoDomains may assign or transfer its rights and obligations under these Terms without restriction.
You may not assign or transfer your rights or obligations without GoDomains’ prior written consent.
27. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect.
28. WAIVER
Failure by GoDomains to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights.
29. ENTIRE AGREEMENT
These Terms, together with any incorporated policies and service-specific agreements, constitute the entire agreement between you and GoDomains regarding the Services.
30. GOVERNING LAW & DISPUTE RESOLUTION
These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Bahrain.
The parties shall first attempt to resolve disputes through good-faith negotiations.
Any dispute that cannot be resolved amicably shall be submitted to the competent courts of the Kingdom of Bahrain.
